Ok it looks like I am going to go into phase two here.. the first thing I wanted to do was ask you if you could send me a revision of the document you sent me regarding my allegations. I can't read it to tell you the truth I can't figure out

When you say we deny something I can't tell what part you're denying so if you could just quote the text you are denying [ok] I would appreciate that. The other thing I want to ask you, if it's fair enough that I asked this question of you, how do I go about subpoenaing people? like if I want to subpoena everyone who sent me a letter or who has testified to me over the telephone.

So any legal motions I have to file through a judge threw the judge [yeah] I can't file them through any other.. I don't get any legal representation to file any

I I don't know.. to tell you the truth in the Tax Court how that works I know... like say for instance Legal Services because I did work for Legal Services for a summer during law school and if you meet income requirements there [ forget about that] I don't know about their involvement in Tax Court I would assume may be able but normally they were in Superior regular state court but I I think they would be able to a would have people there...

Past experience tells me that's a waste of time

Ok.. um the only other thing you might wanna contact like the State Bar association New Jersey Bar Association because a they may um have a... I know.. it doesn't apply to us because we're because we work for the state but every attorney in New Jersey is required to do a certain number of pro bono hours and so I think they fill in the gap for people who don't necessarily meet the income requirements for legal services but still...

Well I meet the income requirements but it's a sham business they wouldn't help me with my social security disability

yeah and I will try the ACLU also. The other thing I wanted to ask you about was did you have conversation with the Tax Division regarding a settlement.

I did.. I did.. I actually just heard back from them I believe it was Wednesday and I have just been swamped or I would have called they um I think.. one thing I was checking about was what their position was with respect to settlement and and they're not interested at all their final determination in this case is what they're comfortable with. so that's what I wanted to gauge with them was if there was a figure that they would go to and if you were interested in just to kind of get an idea because, ua I try to do that in every case and a there they don't feel like they need to settle at all.

yeah, well they're going to feel it..don't.. you know none of you have taken me seriously but I will not stop I will spend the next 50 years.. whenever I got left.. the days I got left breathing [yeah] making life miserable for the state of New Jersey [ok] it's going to be that simple [right] your not getting away with it. you're especially not getting away with that judge idiot who calls up for.. I mean what is this nonsense anyway you tell me we're having a hearing and all he's doing is telling [ well it was in fact] fulfilling his [yeah] little flunky state duty to inform me of one and only one law in the state in New Jersey about amnesty. I mean don't you see anything at all wrong at all with this.. I mean don't you take an oath to defend the Constitution when you take your job don't you [yes and that's what I'm doing] and liberty interests, and the Bill of Rights.. do really think that's what you.. you think having a judge call me and try to solicit, or or or persuade or impell me.. especially with the 5% penalty.. to take and amnesty program do you really think that's consistent with constitutional principles... I mean this whole law itself... why do you think they passed prohibition as a constitutional amendment because they couldn't get away doing it in the tax laws.. they could have just tax liquor $50 an ounce well it would have been effective prohibition it would've been exactly the same thing but they knew that smelled [right] that would be a violation of the Constitution

Let me just say one thing so you're clear

I'm just not clear about all you bureaucrats having a duty.. like I said I've been through this process and I get so much insincerity from people they say " oh yes it's our job to evaluate but we know they're not doing an evaluation... it's just like social security they automatically deny you the first two times, they force you to go through the whole court process [right] there is no real chance.. if anyone made the statistics public we would know that every initial application is denied they never not deny the first application it is is perfunctory lying and that's what I feel like this whole process is... especially now that I have.. well now me in the judge are on great terms now because he calls me up and tells me we're not gonna discuss the case " no iam just going to give you a speech about the fact that you should accept amnesty

well lot of.. it wasn't a hearing of the case it was a status conference.. so there hasn't been hearing

Just the way that sounds do you understand how bad, [yeah] it is for a judge to be telling me that you you should just give up... I mean what.. do think that's really American..[ I think] the first thing a judge should say to the defendant.. the first thing coming out of the judge's mouth to the defendant is well I think Mr. defendant you should just give up One thing I just want to make sure you're clear on with respect to a the Jenkins act which is the federal law which requires these unlicensed distributors to inform States who purchased the cigarettes through the Internet.. is a federal law and like the judge indicated there's nothing that's going to happen in New Jersey Tax Court that's going to allow you to somehow attack that law... you'd have to bring some kind of federal lawsuit so... he's operating under.. you have to understand the concept of jurisdiction.. you may not like it

I understand but the state of New Jersey is the one using the evidence. my point is they gathered the evidence illegally.. you can't set up a sting operation that is dependent on some other governments illegal operations...[ based on wha] you can't set up a sting in New Jersey [based on what sir based on]

let's say deception let's say I was deceived ok in the purchase of the cigarettes and the contract I bought the cigarettes under ok I was deceived that's obvious [ well why aren't you... why are you suing] that's an admission in the documentation from the state in New Jersey has admitted I was deceived [ Why are you suing the a smokes advantage] 0h I'm going to sue a s.. a company in Kentucky I can't even get a rational conversation out of a bureaucrat in New Jersey I am going to get one in Kentucky. [ well of]Oh give me a break. maybe eventually that's where I will have to go and then I'll have to start adding damages to my suit because I'm going to have to go through all this horrible aggravation and might drive me all insane in the end.. so who knows where this is all going to end.. I mean it's just it's so disappointing one person after another very polite " oh yes yes yes" just doing our jobs, just doing our jobs and you really can't see how this is just wrong. [ I don't believe it is] that there is a fundamental wrongness in how this is being done

You couldn't do this to any other vice in America if you started putting a tax on mountain climbing equipment, because mountain climbers make all our insurance rates higher... or boaters because we have to have a coastguard go rescue them every few days.. there be outrage.. 0 that's terrible this is a country that believes in freedom and liberty and how can you do that you can't do that with taxes you can't just passed tax law you have to... if you want to prohibit it you have to put an amendment in the Constitution prohibiting it you can't play this game
