Mayor:- - Before we go on to the fees that are on ordinance 21 03.... before we go to the final adoption let me just comment that on talking with the attorney we should take to look at a few of the fees under electronic records relative to the amounts that are being charged... you have a choice this evening of doing one of two things... You can table this motion.. if we do so... it means the motion dies because you can't reintroduce it until after the new year... and it would have to be reintroduced as a new ordinance... or we can introduce it.. and at the first meeting of the new year... we can adopt... we will introduce it for adoption tonight and change it at the first meeting of the new year... so it is your choice on which way you wanna go.

Gerard Dolan:- - the comment that I would like to make about this particular one is that... apparently there was some type of a communication rendered from one of our.....aaa... citizens I would presume or from somebody in the public.... concerning the legality of what we're trying to do... and what I would like to do at this point is to pass that document onto our council... for some comment as to... the legality of what this communication talked about... the communication we got talked-about an ordinance that doesn't exist... 102-3 that's what the communication said... we don't have an ordinance 102-3... and its talking about many elements that violate United States Constitutional Law etc. etc. etc.... the point I'm making is that this communication that was addressed to Cheryl as our clerk ... talks about something that doesn't exist...//

Council Attorney:- - we are creating it by this ordinance section 102-3 ..//

Gerard Dolan:- - No it's not it's not 102-3... it's a different number completely... our ordinance that we are talking about is a...a.. 21 03

Council Attorney:- - He quoted the ordinance the ordinance name has 102-3 ...//

Gerard Dolan:- - it doesn't exist..

Council Attorney:- - when it's actually it's sub chapter section [made unintelligible by multiple voices]...

Gerard Dolan:- - what he presented does not exist

Mayor:- - he's quoting the chapter as opposed to the ordinance...

Council Attorney:- - right

Mayor:- - we are amending chapter 102-1 this is..//

Gerard Dolan:- - but he's talking about "ordinance"

Mayor:- - he named the wrong number..

Gerard Dolan:- - I understand... so the communication is invalid...

Council Attorney:- - well not really...

Mayor:- - well not really [jinx]

Council Attorney:- - ..he has [unintelligible 4?] points to make...

Mayor:- - what's happened is...: Go ahead Paul

Gerard Dolan:- - no

Mayor:- - the council has been looking into his communications ... based on the communications... Council has looked at it before this meeting... and when they [unintelligible] here tonight what they're saying... they done some research into the fees that are typically charged... for those items and feel that there is an adjustment needed... they're not ready to give us that adjustment because...

Council Attorney:- - well we can't [mixed voices unintelligible] already introduced

Mayor:- - we can't change this ordinance at this point because it's too far into the process

Gerard Dolan:- - so the choice is we either reintroduce it, approve it and amend it

Mayor:- - and amend it the first of the year

Gerard Dolan:- - fine

Mayor:- - ok

Gerard Dolan:- - I was just trying to point out that what was in this document that we received... is not ...does not apply

Mayor:- - yeah ok [introduction: be resolved bla bla bla......].....

Mayor:- - there being no comment from the public... will close the public portion of the meeting be it resolved// [lawyer says something to mayor.. mayor interrupts]

Mayor:- - before we go... we did have a communication in writing from a citizen... that all of you have been copied on... and I would say just for the record that that will be in our minutes..

Council Attorney:- - right

Mayor:- - and that you all have considered it //

Mayor:- - and read it.... we can go forward sorry [be it resolved... that bla bla bla]

Mayor:- - // any discussion

Unknown Councilperson:- - we will look at the Electronic Mail after the first of the year

Mayor:- - we will have an amendment ready immediately on that

Unknown Councilperson:- - for the public... there is time and energy spent preparing e-mail and transferring data from one system to another... and this petty individual can request information and it takes time from our clerk, our administrator, our employees so there should be a fee set for that time and labor

Council Attorney:- - the comments from the communication received was that some of the fees were a little too high... and we are looking at those... and seeing if that needs to be

Mayor:- - counsel is looking into fees other towns charge.. for the same amount... appears that some are a little bit lower.. not significantly.. but a little bit lower.

Council Attorney:- - but the fees have to reflect the actual cost and we are going to...//

Mayor:- - have to reflect actual cost... he had a valid point, and we are going to take that into consideration..
